SUMMARY: On February 19, 2015, the Board of Harbor Commissioners (Board) approved a Permanent and Temporary Order amending the Port of Los Angeles (Port) Tariff No. 4 (Tariff No. 4) Section One -“Definitions”, and Section Thirteen - “Parking Charges”, amending tariff language that was no longer applicable, and increasing parking rates effective March 1, 2015, or thereafter upon approval by the Los Angeles City Council. The daily rate increased to $2.00 per hour and includes the first hour of free parking. The new maximum daily rates for a 24-hour day for standard vehicles became:

Monthly parking charges increased to $80.00 per month from $61.00, and oversized vehicles (there was no prior rate for oversized vehicles) increased to $160.00. With the same number and duration of parked vehicles, the estimated additional revenue to the City of Los Angeles Harbor Department (Harbor Department) for calendar year 2015 would be $607,344. All rates are inclusive of the City of Los Angeles Vehicle Parking Occupancy Tax. A Second Temporary Order is required to allow additional time for the Permanent Order to pass through the City Council approval process. This Temporary Order, if approved, will expire 90 days after the day it is published or upon execution of the Permanent Order by City Council, whichever comes first.

Recommendation: Board resolve to (1) adopt Second Temporary Order No.____________ to amend the Port of Los Angeles Tariff No. 4, Section One - “Definitions”, Item No. 100 and Section Thirteen - “Parking Charges”, Item No. 1300; (2) authorize the Board Secretary to certify the adoption of the Second Temporary Order by the Board and cause the same to be published once in a newspaper printed and published in the City of Los Angeles, to take effect prior to adoption by Ordinance for a period not-to-exceed 90 days pursuant to Charter Section 653(b) and transmit the Temporary Order to the Chief Wharfinger for implementation and posting to the Port of Los Angeles website as regulated by the Federal Maritime Commission.

2. Re: RESOLUTION NO. ____________ - AGREEMENT BETWEEN THE CITY OF LOS ANGELES HARBOR DEPARTMENT AND KLEIN SYSTEMS GROUP LTD. FOR BILLING AND PILOT SYSTEMS SOFTWARE LICENSES, MAINTENANCE AND SUPPORT SERVICES

SUMMARY: The City of Los Angeles Harbor Department (Harbor Department) is requesting approval to enter into an agreement with Klein Systems Group Ltd. (Klein), located in British Columbia, Canada to provide software licenses, maintenance, and professional technical support services for the Harbor Department Billing and Port Pilot Systems. These services are needed to continue to use these systems and to improve their capabilities, including enhancing billing processes, streamlining Port Pilot operations, and implementing future billing requirements. This recommendation is based on a sole-source selection process because Klein is the only company that provides services for its proprietary software products.  The term of the proposed agreement is five years at a not-to-exceed amount of $3,000,000. The Billing and Port Pilot software licenses, maintenance and support costs are the financial responsibility of the Harbor Department.

Recommendation: Board resolve to (1) find that in accordance with the Los Angeles City Charter Section 1022, it is more feasible for outside contractors to perform this work than City employees; (2) find that the proposed Agreement qualifies for award on a sole source basis as a contract for the performance of professional, technical and special services for which competitive bidding is undesirable, impractical, or would not produce an advantage, pursuant to Los Angeles City Charter, Section 371(e)(10) and Los Angeles Administrative Code Section 10.15(a)(10); (3) approve the agreement with Klein Systems Group Ltd. at an amount not to exceed $3,000,000 for a five-year term; (4) authorize the Executive Director to execute and the Board Secretary to attest to the proposed Agreement, upon approval by the City Council; and (5) adopt Resolution No.____________.

3. Re: RESOLUTION NO.____________- TEMPORARY ENTRY AND USE PERMIT NO. 1505 WITH MEADOW LAKE, LLC. FOR PREMISES IN THE OUTER HARBOR, SAN PEDRO

SUMMARY: The City of Los Angeles Harbor Department (Harbor Department) proposes to grant a six-month Temporary Entry and Use Permit (TEUP) to Meadow Lake, LLC. (ML) for the construction, operation, and maintenance of a temporary live entertainment venue at the Outer Harbor in San Pedro (Berths 45-49). ML has previously produced and operated many successful shows in cities throughout Britain and other countries. This year, ML has selected the Port of Los Angeles as its first United States location for its events. The Outer Harbor facility is a short-term, multi-use facility used for three-ship cruise operations and other special events. The estimated gross revenue to the Harbor Department is $683,268 for the six-month term of the TEUP.  Staff has negotiated an in-kind exchange of a minimum of $300,000 in joint media and publicity value for the LA Waterfront for approximately $178,976 in rent abatements.

Recommendation: Board resolve to (1) approve Temporary Entry and Use Permit No. 1505 between the City of Los Angeles Harbor Department and Meadow Lake, LLC.; (2) authorize the Executive Director to execute and the Board Secretary to attest to Temporary and Use Permit No. 1505; and (3) adopt Resolution No.____________.
