IMPORTANT – PUBLIC HEARING NOTICE
Port of Los Angeles

 

Pursuant to the California Coastal Act of 1976 as amended and the Port of Los Angeles’ certified Port Master Plan, notice is hereby given to all interested persons and organizations that the Los Angeles Board of Harbor Commissioners (Board) will hold a public hearing to hear, receive evidence, and adjudicate the appeal of:
 

Level I Coastal Development Permit No. 18-25
Landside Infrastructure to Operate Battery-Electric Powered Equipment

 
In accordance with the Guidelines of the Port Master Plan, the Los Angeles Board of Harbor Commissioners will hold a public hearing on July 11, 2019 at 9:00 a.m. and estimated to conclude at 12:00 p.m. at the Cruise Terminal Baggage Handling Facility located at 250 S. Harbor Blvd., San Pedro CA 90731 (gray dome adjacent to the Battleship IOWA) to hear, receive evidence, and adjudicate an appeal of the above entitled Coastal Development Permit (CDP). The appeal was lodged on February 21, 2019 at the Board of Harbor Commissioner regularly scheduled meeting as the CDP was being reported to the Board. 
 
APPEAL ISSUE:  The issue for this hearing and the question for the Board’s consideration is whether or not the CDP was issued consistent with the certified Master Plan and the California Coastal Act (Master Plan § 6.7.3).  
 
HEARING PROCEDURES:  All public commenters will be limited to one (1) minute. The Board President has the “…right to accept a motion to conclude the taking of oral testimony or to close the public hearing when a reasonable opportunity to present all questions and points of view has been allowed.” (Master Plan § 6.5.2). Any person unable to attend the public hearing may submit written comments to the Director of Planning and Strategy, P.O. Box 151, San Pedro, CA 90733. Written materials must be submitted to Harbor Department staff no later than 5:00 p.m. on the Friday before the hearing (staff will then distribute your materials to the Board). Note that materials received after this time may not be distributed to the Board. Please summarize your position in no more than two or three pages if possible. Please Note: You are discouraged from submitting written materials to the Board on the day of the hearing, unless they are visual aids. It is difficult for Commissioners to carefully consider late submittals (California Coastal Commission Meetings – Rules & Procedures).

Rules:
 
1. Commissioners may ask questions throughout.
2. Speakers are encouraged to co-ordinate testimony.
3. All those who want to testify must fill out a speaker’s slip before the start of the hearing.
4. Elected Officials and Public Agency Representatives:  Maximum of 1 minute each.
5. Individual members of the public – Maximum of 1 minute each.
6. Ceding of time:  No ceding of time will be allowed.
7. No audible outburst will be allowed.  You may wave your hands to show your support or give the thumbs down to signal your opposition.
8. The vote will be a simple majority of the Board (3 votes are needed).
 
Note: To preserve adequate time for Commission deliberation, the Chair reserves the right to close the public hearing after a reasonable opportunity to present all questions and points of view has been allowed.

BOARD MEETINGS
The Board’s Regular Meetings are the first and third Thursday of each month at 9:00 A.M. at the Harbor Administration Building Boardroom or as scheduled on the Port’s website at www.portoflosanageles.org. A quorum of three of five Commissioners is required to transact business and three Aye votes are required to carry a motion. Commission actions, except actions which are subject to appeal or review by the Council pursuant to other provisions of the Charter, ordinance or other applicable law, are not final until the expiration of the next five meeting days of the City Council during which the Council has convened in regular session. If the Council asserts jurisdiction during this five meeting day period the Council has 21 calendar days thereafter in which to act on the matter.

In the event the agenda is revised prior to the meeting, Port staff will post the revised agenda on the Port’s web site (http://www.portoflosangeles.org). OPPORTUNITIES FOR THE PUBLIC TO ADDRESS THE BOARD
Before reaching those portions of the agenda where Board action is requested, members of the public will be given an opportunity to address the Board on items of interest within the subject matter jurisdiction of the Board (general public comment). Thereafter, members of the public will be given an opportunity to address the Board on any item on the consent or regular agendas prior to or during the Board’s consideration of that item. The same opportunity will be given in open session regarding the closed session agenda prior to commencement of closed session.  Members of the public who wish to speak during general public comment are to complete a speaker card so indicating. Members of the public who wish to speak regarding a particular agenda item(s) are to complete a speaker card(s) for each such item. Agendas for special meetings will permit the public to address particular agenda items even where the agenda does not include general public comment. Each speaker is allowed to speak up to 3 minutes per agenda item. The Presiding Officer shall, however, exercise discretion to determine whether such period of time should be reduced or extended based upon such factors as the length of the agenda or substance of the agenda items, the number of public comment speaker cards submitted, the need for the Board to conclude its business as expeditiously as is practicable, and whether the Board is at risk of losing a quorum, among other factors. Upon request, non-English speakers will be granted additional speaking time for translation assistance.

If you request to distribute documents to the full Commission, please present the Board Secretary with twelve (12) copies.  Otherwise, your materials will simply be added to the official meeting record. Requests to distribute literature to the general public attendees of the meeting shall be placed on a literature table outside the Boardroom during and until 30 minutes after the Board meeting.
